Terms and Conditions



These are the terms and conditions relating to the Quest QClub ('the QClub').

1.Definitions
In these terms and conditions, unless the context otherwise requires:
  1.1 'Associate' has the same meaning as associate as defined in Section 318 of the Income Tax Assessment Act 1936 (Cth) (as amended);
  1.2 'Bonus Rewards' means entitlements which may, at the discretion of Quest, be made available, from time to time, to all Members or certain Classifications of Members;
  1.3 'Classification' means the classification of a Member which is made by Quest, at its absolute discretion;
  1.4 'Eligible Stay' means a stay at a Participating Quest Property for which the Member will be entitle to earn QClub Dollars;
  1.5 'Entitlements' means the entitlements which Members are entitled to as a result of being a Member of the QClub and include General Member Entitlements and Bonus Rewards;
  1.6 'General Member Entitlements' means the benefits which are available to Members as a result of being a Member;
  1.7 'Member' means a person who is invited, and accepts an invitation, to join the QClub;
  1.8 'Membership Card' means the card issued by, or on behalf of, the QClub to a Member which card evidences the membership of a Member with the QClub;
  1.9 'Nominated Partners' are partners of the QClub with whom an association has been formed;
  1.10 'Participating Quest Businesses' means a Quest business which is participating in the QClub;
  1.11 'QClub' means the Quest QClub which is the loyalty program associated with the Quest Serviced Apartment Group;
  1.12 'the QClub Operator' means Quest and/or any other entity which has been engaged by Quest to assist with the management and operation of the QClub;
  1.13 'Quest' means Quest Serviced Apartments Pty Ltd ACN 119 523 483; and
  1.14 'Terms and Conditions' means these terms and condition.

2.Application
  2.1 These Terms and Conditions apply to the QClub.
  2.2 Any person who is granted membership of the QClub will be bound by these Terms and Conditions.
  2.3 Quest has used all reasonable efforts to ensure that the information contained herein is accurate and correct. However to the extent permitted by law, Quest accepts no responsibility for any inaccuracy.
  2.4 Quest reserves the rights to vary these Terms and Conditions at its sole discretion at any time and without the need for any prior notice to Members. It is a Members responsibility to ensure that it is aware of the Terms and Conditions which apply to the QClub.
  2.5 Members acceptance of membership of the QClub confirms a Members acceptance of these Terms and Conditions.

3.Membership
  3.1 Membership is open to individuals.
  3.2 In order to become a Member, an individual must be invited to become a Member by either;
    3.2.1 Quest or an Associate of Quest; or
    3.2.2 a franchisee of Quest,
    PROVIDED THAT Quest reserves its rights, to, at any time, withdraw an invitation which has been provided (by either Quest or a franchisee of Quest) to an individual to join the QClub.
  3.3 An individual will be deemed to be a Member in the event that it has not specifically rejected an offer of membership of QClub.
  3.4 Membership is not transferrable.
  3.5 A Member must not transfer or otherwise attempt to deal with any of the benefits associated with the QClub.
  3.6 It is the Members responsibility to ensure that Quest is made aware of any changes to its profile (including contact details etc).
  3.7 A Member can update its profile at any time at www.questapartments.com.au/qclub

4.Classification of Members
Quest reserves its rights to, at its absolute discretion:
  4.1 create a Classification for Members within the QClub; and
  4.2 if applicable, establish separate entitlements and benefits for each Classification of Members.

5.Term of Membership
Membership of the QClub may be cancelled at any time;
  5.1 by Quest, at its absolute discretion, without reason as and when it deems fit; and/or
  5.2 by a Member, by way of notification in writing by the Member to Quest.

6.Membership Fees
There is no fee to join the QClub.

7.Membership Card
  7.1 Upon acceptance of becoming a Member, a Member will be assigned a membership number and issued with a Membership Card.
  7.2 The Membership Card can only be used by the individual whose name appears on it.

8.Participating Quest Businesses
  8.1 The benefits of Membership with the QClub will be available only at Participating Quest Businesses and Nominated Partners.
  8.2 Not all Quest businesses may participate in the QClub. In the event that a Quest business does not participate in the QClub, Members will not be entitled to;
    8.2.1 accrue QClub Dollars when staying at a non participating Quest Business; and/or
    8.2.2 redeem Entitlements from a non participating Quest Business.

9.Member Entitlements
  9.1 Members will be able to claim Entitlements;
    9.1.1 by way of a Member redeeming its QClub Dollars; and/or
    9.1.2 subject to any conditions associated with an Entitlement which may be imposed by Quest.
  9.2 Members Entitlements may vary subject to the Classification of the Member.
  9.3 With respect to the Entitlements, Members will be entitled to;
    9.3.1 General Member Entitlements; and
    9.3.2 Bonus Rewards (if applicable).
  9.4 Members will be able to claim Entitlements;
    9.4.1 late check out – providing the Member with the right to check-out of the accommodation provided at a Participating Quest Business at 11.00 AM rather than the standard check-out time. This offer is subject to availability (that is that the accommodation provided by the Participating Quest Business is not 100% reserved for the date of check-out of the Member);
    9.4.2 complimentary newspaper on the first morning of a Members stay;
    9.4.3 preferred room. All reasonable endeavours will be made to provide a Member with any requested room subject at all times to availability; and
    9.4.4 periodic promotions.
  9.5 Bonus Rewards are to be determined from time to time by Quest (at its absolute discretion), and may include, but not be limited to the following:
    9.5.1 discount vouchers;
    9.5.2 coupons;
    9.5.3 gifts; and/or
    9.5.4 periodic promotions.

10.QClub Dollars
  10.1 Members will be entitled to use QClub Dollars in order to claim Entitlements.
  10.2 Members will be entitled to receive QClub Dollars for Eligible Stays with a Participating Quest Business. Quest reserves its rights to specify what constitutes an Eligible Stay and to, at its absolute discretion, from time to time, change the guidelines associated with an Eligible Stay.
  10.3 In order for a Member to earn QClub Dollars, a Member must present its Membership Card at the time of check in at a Participating Quest Business.
  10.4 A Member will receive Twenty Five (25) QClub Dollars for every five (5) nights stayed at any Participating Quest Business during the immediately preceding three (3) months.
  10.5 Additional QClub Dollars may be provided to Members at the discretion of Quest as part of a special promotion or reward.
  10.6 QClub Dollars cannot be redeemed for cash.
  10.7 Any unused QClub Dollars will automatically expire at the expiration of six (6) months from date of issue.
  10.8 If more than one (1) Member stays in an apartment, QClub Dollars are only earned by one (1) Member.
  10.9 QClub Dollars are not earned by any Member on account of any stay at a Participating Quest Business in the event that the Member has redeemed QClub Dollars or taken advantage of a special QClub offer for the purposes of that stay. In relation to other loyalty programs, the rules of that specific program will apply.
  10.10 The maximum number of QClub Dollars which may be earned for each stay by a Member is limited to the QClub Dollars attributable only to the first ten (10) days of a Members stay.

11.Redemption of QClub Dollars
  11.1 Members may redeem QClub Dollars for General Member Entitlements and/or certain Bonus Rewards. Full details of the applicable QClub Dollars required so as to secure the General Member Entitlements and Bonus Rewards will be made available to Members by Quest from time to time.
  11.2 In order to redeem QClub Dollars at a Participating Quest Business, a Member must:
    11.2.1 advise the Participating Quest Business at the time of the making of the reservation; and
    11.2.2 present their Membership Card at both check in and check out.
  11.3 In order to redeem QClub Dollars at any participating partner of the QClub, a Member must comply with the terms and conditions imposed by the participating partner.
  11.4 QClub Dollars can only be redeemed for a maximum of seven (7) nights per stay.
  11.5 Quest reserves its rights to, at any time and at its absolute discretion, review and change the amount of QClub Dollars required to be redeemed for the purposes of a General Member Entitlement and/or a Bonus Reward.

12.General
  12.1 Jurisdiction
    These terms and conditions are governed by and will be construed in accordance with the laws of the State of Victoria and the parties hereto hereby irrevocably submit to the jurisdiction of the courts of that State.
  12.2 Tax Consequences
    Quest makes no representations of any kind whatsoever in relation to any tax related consequences associated with a Members participation in the QClub including its redemption of QClub Dollars and/or acceptance of rewards relating to the QClub. All Members;
    12.2.1 are required to familiarise themselves with any possible tax implications; and
    12.2.2 are responsible for any tax consequences,
    associated with the QClub.
